News: 4th District Court Refuses to Resurrect Long-Dormant Water Right in C&J Case
C&J’s water lawyers scored a resounding victory in a recent state court ruling that rejected Defendant South Utah Valley Municipal Water Users Association’s (“SUVMWA”) attempt to resurrect a large but long-dormant water right.  At stake was approximately 4,000 acre feet of water that SUVMWA was trying to supplant from C&J’s client and others.  Fourth District Court Judge Lynn W. Davis wrote that “only the Plaintiff's reading of the statute will coincide with Utah’s history of water law,” while “Defendant’s reading of the statute would only serve to extend already long periods of time of nonuse which is counter to the State’s vital interest in seeing that the water it holds in trust for the public is put to beneficial use.”  Read Judge Davis’ 87-page opinion here, and read more about the case here.

Sarah Elizabeth Spencer presented during a plenary session of the Utah State Bar’s Spring Convention on March 17, 2022. She was joined in her presentation by Utah Supreme Court Justice Paige Petersen, University of Utah Professor Anna Carpenter, prominent Utah solo practitioner Virginia Sudbury, and moderator Michelle Oldroyd. Sarah Elizabeth Spencer and Anna P. Christiansen won a motion for summary judgment in a case involving alleged sale of contaminated diesel fuel
Sarah Elizabeth Spencer and Anna P. Christiansen won a motion for summary judgment in a case involving alleged sale of contaminated diesel fuel by their client’s gas station. Sarah and Anna successfully demonstrated why their client was not liable for the plaintiff’s negligence or breach of contract claims, arguing there was no evidence their client sold contaminated fuel. The court agreed. The court found that the claims were factually and legally unsupported and dismissed them in total.
