Dispute Resolution

Cases are taking longer to get to trial; fewer are actually being tried to juries.  Modern litigation is expensive and risky.  More often now, parties are choosing to mediate their disputes or go to private arbitration than await court dates.  Clients are recognizing the benefits of party-influenced dispute resolution processes. 

Christensen & Jensen is adept at the methods and practices of alternative dispute resolution, particularly the ADR mainstays of mediation and arbitration.  We work with some of the finest mediators and arbitrators. 
Members of the firm have been leaders in Utah’s dispute resolution community from the start, holding positions on the State Court’s ADR advisory committee, on the board of Utah Council on Conflict Resolution, Inc., co-founding and leading the Utah State Bar’s Dispute Resolution Section, and teaching dispute resolution principles and practices at Utah’s ADR Academy, the Utah State Bar’s Annual Convention and other settings. 

Not only are members of the firm experienced advocates in ADR settings, but they are also called upon to serve as the mediator, arbitrator, and special master in various disputes. Two of the firm's members, Craig V. Wentz and Nathan D. Alder, received their mediator training at Pepperdine University's prestigious Straus Institute for Dispute Resolution.   

The firm has had strong experience with ADR over a vast range of topic areas, from typical two-party disputes to high level, complex, and multi-million dollar mediations and arbitrations. With experience, we know what cases are appropriate for ADR, when to infuse ADR into the process, and how to successfully guide cases to resolution.  Our attorneys continually receive updated ADR training.  As leaders, educators, neutrals and advocates in this important field, we embrace the many positive benefits of dispute resolution for a spectrum of cases. 

Nathan D. Alder is the Chair of the Dispute Resolution Practice Group at Christensen & Jensen; Members of the Dispute Resolution group include Dale J. Lambert, Craig V. Wentz, Karra J. PorterGeoffrey C. Haslam, and Scott T. Evans. Other attorneys also participate.
