The firm has specific expertise in defending professionals engaged in the construction industry (e.g. architects, contractors, engineers) and representing select plaintiffs in cases involving claims of alleged construction defect. The firm has substantial experience in commercial, public and residential construction issues, both in property damage claims and personal injury arising out of alleged defects. The firm’s experience includes the following examples.
• Successfully represented an architectural firm in a major design and construction defect case brought by condominium owners association in which the Utah Supreme Court ruled that association could not maintain causes of action for unjust enrichment or implied warranty of habitability, American Towers Owners Ass’n v. CCI Mechanical, 930 P.2d 1182 (Utah 1996).
• Represented an architect in Utah Supreme Court case limiting scope of damages against construction professionals, Stevensen v. Goodson, 924 P.2d 339 (Utah 1996).
• Successfully represented a Fortune 500 construction company in claims arising out of utility construction.
• Successfully represented a national design firm in claims arising out of design of power plant.
• Successfully represented an architect and the architect’s firm’s interests in major construction litigation between an owner and the general contractor. Kept the architect from being named as a defendant and from contributing to the settlement.
• Successfully represented contractors and property owners in relation to disputes over liens.
• Represent numerous injured workers in claims arising out of construction site injuries.
