AREAS OF PRACTICE Land Development and Litigation. Representation of commercial and residential developers with respect to the resolution and litigation of environmental, site acquisition, zoning, subdivision, conditional use, development permit, administrative appeal, easement and adverse possession issues, including the litigation of state and federal constitutional claims.
• Counsel to Utah developers with respect to annexation, environmental due diligence, zoning, subdivision and development permit issues for large residential and commercial projects. • Counsel to numerous Utah towns, cities, and counties with respect to land use issues, including the successful defense of scores of cases against municipalities involving allegations of inverse condemnation, unjust compensation, due process, equal protection, and arbitrary and capricious claims in Utah’s State and Federal courts. • Counsel to national shopping center developer in the Seattle area with respect to land acquisition, zoning, land development permits, formation of special improvement districts, and lien claims, culminating in the opening of the Alderwood Mall Regional Shopping Center. • Counsel to national shopping center developer with respect to zoning, traffic and environmental issues, culminating in a major expansion of the Tacoma Mall Shopping Center in Tacoma, Washington. • Counsel to regional residential developer located in the Seattle area with respect to land acquisition, rezoning, subdivision, development and contract disputes, culminating in a multi-phase residential development east of Lake Washington.
Commercial Litigation: Defend broker-dealers against misrepresentation, unsuitability and failure to supervise claims; defend individuals and business entities against breach of contract, negligence and/or fraud or misrepresentation claims.
